What is considered rape?

According to the Ohio Revised Code (O.R.C. §2907.02), there are several different ways that rape can occur. Here's an overview:

  • Using force or threat of force to make someone engage in sexual conduct with the offender against his or her will
  • Giving the victim a drug, intoxicant or controlled substance for the purpose of preventing resistance and then engaging in sexual conduct with that victim
  • Engaging in sexual conduct with someone who is unable to provide consent, such as someone who has a physical or mental impairment or someone who is too advanced in age to be able to resist or consent
  • Engaging in sexual conduct with someone who is under 15 years of age (whether or not the offender knows the victim's age)

In the state of Ohio, rape is classified as a first-degree felony. Depending on the type of rape that allegedly occurred and other details of the allegations, a person convicted of rape can spend anywhere from just a few years to life without parole in prison.
