Have you been arrested and charged with a drug offense in North Central Ohio? It is important to understand the penalties that you could face if convicted and how drug crimes work in this state. Chapter 2925 of the Ohio Revised Code discussed drug laws in the state in detail.

If you are arrested for a drug crime, you could face a range of penalties depending on the type of drug as well as action involved in your case. There are certain crimes that can carry more severe penalties than others. For example, possession of controlled substances is forbidden under ORC § 2925.11 and involves the deliberate acquisition, possession, or usage of an illegal drug such as marijuana or cocaine. This is one of the most common drug crimes, while trafficking and manufacture — prohibited under ORC § 2925.03 and 2925.04, respectively — carry some of the most severe penalties.

Understanding the Drug Schedule in the State of Ohio

In Ohio, controlled substances are divided into five schedules in ORC § 3719.41. This schedule is only slightly different than the controlled substance schedule used at the federal level. The drugs within these schedules are ranked according to addictiveness, potential for abuse, and recognized medical use.

The most dangerous substances are classified under Schedule I, while those that have the least potential for abuse and the most recognized medical use are classified under Schedule V. Some examples of drugs that fall under these various schedules include:

  • Schedule I: LSD, marijuana, GHB, ecstasy, heroin
  • Schedule II: opium, cocaine, methamphetamine
  • Schedule III: testosterone, ketamine, anabolic steroids, codeine
  • Schedule IV: clonazepam, sedatives
  • Schedule V: over the counter medication taken with codeine, narcotic preparation medications in low dosages
